TERMS OF SALE

1. The Agreement
The agreement consists of these terms of sale, the information given in the order solution, and any separately agreed terms. In the event of conflict between the information, what has been separately agreed between the parties takes precedence, provided it does not conflict with mandatory legislation. The agreement is further supplemented by relevant statutory provisions governing the sale of goods between businesses and consumers.

2. The Parties
The seller is Blank Habit AS, Frydenlundgata 3a, 0169 Oslo, org. no. 925 250 309, hereinafter referred to as the seller. The buyer is the consumer who places the order, hereinafter referred to as the buyer.

3. Price
The stated price for the goods and services is the total price the buyer shall pay. This price includes all taxes and additional costs. The buyer shall not bear any additional costs that the seller has not informed about before the purchase.

4. Conclusion of the Agreement
The agreement is binding on both parties once the buyer has submitted the order to the seller. The agreement is nevertheless not binding if there has been a typographical or input error in the offer from the seller in the order solution, or in the buyer's order, and the other party realised or should have realised that such an error existed.

Subscription with no commitment or purchase obligation
Shopping with us should be simple. Blank Habit offers refills on an ongoing subscription basis, delivered straight to your door — so you never run out.

There is no minimum term, and you can cancel your subscription at any time. You can cancel easily by logging into your account page; on cancellation, the subscription stops immediately and you will not be charged further. If you didn't create an account when you first ordered, you can do so from the same page using the email you ordered with. You can also cancel by contacting customer service.

Renewals are charged automatically to the payment method you used when you started the subscription, until you choose to cancel.

5. Payment
The seller may charge for the goods from the time they are dispatched from the seller to the buyer. If the buyer pays by credit or debit card, the seller may reserve the purchase amount on the card at the time of ordering. The card is charged on the same day the goods are dispatched. For payment by invoice, the invoice is issued on dispatch of the goods. The payment deadline is stated on the invoice and is a minimum of 14 days from receipt. Buyers under the age of 18 cannot pay by subsequent invoice.

6. Delivery
Delivery has taken place when the buyer, or the buyer's representative, has taken possession of the goods. If no delivery time is stated in the order solution, the seller shall deliver the goods to the buyer without undue delay and no later than 30 days after the order. The goods shall be delivered to the buyer unless otherwise separately agreed.

7. Risk for the Goods
The risk for the goods passes to the buyer when the buyer, or the buyer's representative, has received the goods in accordance with clause 6.

8. Right of Withdrawal
Unless the agreement is exempt from the right of withdrawal, the buyer may withdraw from the purchase in accordance with the Norwegian Right of Withdrawal Act (angrerettloven).

The buyer must notify the seller of the use of the right of withdrawal within 14 days from when the deadline begins to run. The deadline includes all calendar days. If the deadline ends on a Saturday, public holiday or official holiday, it is extended to the nearest working day.

The deadline is deemed met if notice is sent before it expires. The buyer bears the burden of proof that the right of withdrawal has been exercised, and notice should therefore be given in writing (withdrawal form, email or letter).

The withdrawal period begins to run:

  • For the purchase of individual goods, from the day after the goods are received.
  • For a subscription, or where the agreement involves regular delivery of identical goods, from the day after the first delivery is received.
  • Where the purchase consists of several deliveries, from the day after the last delivery is received.

The withdrawal period is extended to 12 months after the end of the original deadline if the seller has not, before conclusion of the agreement, informed about the right of withdrawal and provided the standardised withdrawal form.

On use of the right of withdrawal, the goods must be returned to the seller without undue delay and no later than 14 days from notice. The buyer covers the direct cost of returning the goods, unless otherwise agreed or the seller has failed to state that the buyer must cover return costs. The seller may not charge a fee for the buyer's use of the right of withdrawal.

13. Personal Data
The data controller for personal data collected is the seller, Blank Habit AS.

14. Dispute Resolution
Complaints are directed to the seller within reasonable time. The parties shall attempt to resolve any disputes amicably. If this is unsuccessful, the buyer may contact the Norwegian Consumer Authority (Forbrukertilsynet) for mediation, available at +47 23 400 600 or www.forbrukertilsynet.no.
